SECOND SUPPLEMENTAL NOTICE OF PIPELINE APPLICATIONS
The REGULATORY COMMISSION OF ALASKA (Commission) supplements three earlier notices dated October 4, 2019 and a supplement notice dated October 23, 2019. This second supplemental notice extends from November 15, 2019 to December 13, 2020, the time for the filing of public comments on the three applications, the petitions for confidential treatment, and the waiver requests noted below. The Commission has extended the notice period to allow the public, who previously may have experienced problems filing comments online, additional time to file comments now that the problems have been addressed.
On September 27, 2019, three applications were filed jointly by BP Pipelines (Alaska) Inc. (BPPA) and Harvest Alaska, LLC (Harvest Alaska). In Docket No. P-19-015, the application requests approval of the transfer to Harvest Alaska of BPPA’s indirect 32.0% ownership interest in PTE Pipeline, LLC, operating under Certificate of Public Convenience and Necessity (CPCN) No. 746. In Docket No. P-19-016, the application requests approval of the transfer to Harvest Alaska of BPPA’s indirect controlling interest in Milne Point Pipeline, LLC, the operator of the Milne Point Oil Pipeline under CPCN No. 329 and the Milne Point Natural Gas Liquids Pipeline under CPCN No. 638. In Docket No. P-19-017, the application requests approval of the transfer to Harvest Alaska of BPPA’s entire interest in the Trans-Alaska Pipeline System (including its interest in the Valdez Marine Terminal) operated under CPCN No. 311. The proposed transfers are part of a larger transaction under which BP is exiting Alaska through the sale of BP Exploration (Alaska) Inc. to Hilcorp Alaska and the transfer of BPPA's Alaska-related assets and interests, including its ownership of BP Transportation (Alaska) Inc., to Harvest Alaska.
With each application, Harvest Alaska filed a motion requesting waiver of the requirement under 3 AAC 48.625(a)(7)(D) that Harvest Alaska file audited financial statements. Harvest Alaska, Hilcorp Alaska, LLC, and Harvest Midstream I, L.P., filed into each docket a petition requesting confidential treatment of their audited and unaudited financial statements submitted in support of the applications.
