NOTICE OF APPLICATION TO AMEND CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY

Notice of Application to Amend Certificate of Public Convenience and Necessity

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on January 3, 2019, Fairbanks Natural Gas, LLC (FNG), filed an application to amend its Certificate of Public Convenience and Necessity (Certificate) to include liquefied natural gas (LNG) storage service to the public through the use of a large new LNG storage facility being constructed in Fairbanks, Alaska. FNG is a public utility that holds CPCN No. 514, authorizing natural gas service in certain areas in Fairbanks, Alaska. Docket No. U-19-002 was opened to address this matter.

FNG is an Alaska limited liability company, wholly owned by Interior Alaska Natural Gas Utility (IGU). IGU was created as a public corporation by the Fairbanks North Star Borough (FNSB), a political subdivision of the State, and, pursuant to AS 42.05.711(b), IGU and FNG are exempt from the Alaska Public Utilities Regulatory Act (AS 42.05) other than AS 42.05.221 through AS 42.05.281. As such, IGU is exempt from economic regulation by the Commission. “Economic regulation” is a generic term which includes the regulation of rates that can be charged by a regulated utility. With respect to IGU and FNG, the Commission has no jurisdiction over matters that constitute economic regulation.

No motions for waiver or petitions for confidentiality were filed with the application. The Commission has not assessed the completeness of the application. The Commission will determine whether the application is complete by January 25, 2019.
