Notice of Proposed Changes in the Regulations of the Board of Dental Examiners

Course of instruction in local anesthetics, facilities and equipment general guidelines, restorative function courses, code of ethics, disciplinary sanctions, application deadline for personal interview, CPR certification, licensure requirements, courtesy license, collaborative agreements, and registration and inspection of dental radiological equipment and forms:
NOTICE OF PROPOSED REGULATIONS CHANGES
BOARD OF DENTAL EXAMINERS


Brief Description:  The Board of Dental Examiners proposes to update various regulations including course of instruction in local anesthetics, equipment and facilities, restorative functions courses, ethics standards, grounds for disciplinary sanctions, application deadline, CPR certification, licensure requirements, courtesy license, registration of dental radiological equipment, and registration and inspection forms.   

The Board of Dental Examiners (Board) proposes to adopt regulation changes in Title 12, Chapter 28 of the Alaska Administrative Code, dealing with requirements for course of instruction in local anesthetics, equipment, facilities and staff standards, restorative function courses, ethics standards, disciplinary sanctions, application deadline for personal interview, CPR certification, licensure requirements, courtesy license, collaborative agreement requirements, and registration and inspection of dental radiological equipment, including the following:
  

  1. 12 AAC 28.340, Requirements for course of instruction in local anesthetics, is proposed to be changed to alter the requirements for course of instruction in local anesthetics.
  2. 12 AAC 28.630, Equipment, facilities, and staff standards, is proposed to be changed to adopt by reference the current revised Anesthesia Evaluation Manual, and to amend the provisions related to equipment, facilities, and staff standards.
  3. 12 AAC 28.770, Requirements for restorative function courses for dental hygienists, is proposed to be changed to update the requirements for restorative function courses for dental hygienists.
  4. 12 AAC 28.905, Ethical standards, is proposed to be changed to adopt by reference the current revised code of ethics for dental hygienists.
  5. 12 AAC 28.906, Disciplinary sanctions, is a proposed new section that establishes additional bases for disciplinary sanctions.
  6. 12 AAC 28.915, Application deadline for personal interview, is proposed to be changed to alter the provisions relating to application deadline for personal interview.
  7. 12 AAC 28.920, CPR certification, is proposed to be changed to alter the requirements for CPR certification.
  8. 12 AAC 28.937, Dental hygienist licensure by credentials, is proposed to be changed to alter the requirements for a license by credentials.
  9. 12 AAC 28.951, Dental licensure by credentials, is proposed to be changed to alter the requirements for a license by credentials.
  10. 12 AAC 28.955, Courtesy license, is proposed to be changed to alter the requirements for courtesy license.
  11. 12 AAC 28.956, Collaborative agreement requirements, is proposed to be changed to update the statutory reference relating to collaborative agreement requirements.
  12. 12 AAC 28.960, Registration of dental radiological equipment, is proposed to be changed to alter the provisions related to registration of dental radiological equipment.
  13. 12 AAC 28.965, Inspection of dental radiological equipment, is proposed to be changed to alter the provisions related to the inspection of dental radiological equipment.
  14. 12 AAC 28.970, Registration and inspection forms; review of completed forms, is proposed to be changed to alter the requirements for registration and inspection of radiological equipment, and to amend the radiological equipment and inspection forms that the board adopts by reference.
You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Jun Maiquis, Regulations Specialist, Division of Corporations, Business and Professional Licensing, P.O. Box 110806 Juneau, AK  99811-0806.  Additionally, the Board will accept comments by facsimile at (907) 465-2974 and by electronic mail at jun.maiquis@alaska.gov.  The comments must be received no later than 4:30 p.m. on May 26, 2015.

Box 110806 Juneau, AK  99811-0806 or by e-mail at jun.maiquis@alaska.gov.  The questions must be received at least 10 days before the end of the public comment period.  The Board will aggregate its response to substantially similar questions and make the questions and response available on the Board’s website at http://commerce.state.ak.us/dnn/cbpl/ProfessionalLicensing/BoardofDentalExaminers.aspx or on the Alaska Online Public Notice System.  The Board may, but is not required to, answer written questions received after the 10-day cut-off date and before the end of the comment period.

After the public comment period ends, the Board will either adopt these or other provisions dealing with the same subject, without further notice, or decide to take no action on them.  The language of the final regulations may be different from that of the proposed regulations.  You should comment during the time allowed if your interests could be affected.  Written comments and questions received are public records and are subject to public inspection.

Fiscal Information:  The proposed regulation changes are not expected to require an increased appropriation.
