Licensure or certification requirements, education requirements, approval as a trainee appraiser, supervision of appraiser trainees, standards for acceptable education, continuing education requirements, and supervision of trainee appraisers

Notice of Proposed Changes in the Regulations of the Board of Certified Real Estate Appraisers. 

Brief Description:  The Board of Certified Real Estate Appraisers proposes to update various regulations addressing application for licensure or certification requirements, education requirements, approval as a trainee appraiser, supervision of appraiser trainees, standards for acceptable education, continuing education requirements, supervision of trainee appraisers, and other provisions required to comply with federal law and also to implement the statutory changes made in Chapter 42, SLA 2014 (SB129).

The Board of Certified Real Estate Appraisers (Board) proposes to adopt regulation changes in Title 12, Chapter 70 of the Alaska Administrative Code, dealing with application for general or residential real estate appraiser certification by examination, reciprocity, institutional, or endorsement; education requirements, application for approval as a trainee appraiser or as a supervisory appraiser, standards for acceptable education, continuing education requirements, and supervision of trainee appraisers, including the following:
 
  1. 12 AAC 70.100, Application for general real estate appraiser certification by examination, is proposed to be changed to alter the licensure or certification by examination requirements to practice as a general real estate appraiser.

     

  2. 12 AAC 70.105, Application for residential real estate appraiser certification by examination, is proposed to be changed to alter the licensure or certification by examination requirements to practice as a residential real estate appraiser.

     

  3. 12 AAC 70.106, Application for general real estate appraiser or residential real estate appraiser certification by reciprocity, is a proposed new section that establishes licensure or certification requirements to practice as a general real estate appraiser or residential real estate appraiser by reciprocity.

     

  4. 12 AAC 70.107, Application for institutional real estate appraiser certification by examination, is proposed to be changed to alter the licensure or certification requirements to practice as an institutional real estate appraiser.

     

  5. 12 AAC 70.115, Education requirements for real estate appraiser certification, is proposed to be changed to alter the education requirements for real estate appraiser certification.

     

  6. 12 AAC 70.120, Application for certification by endorsement, is proposed to be changed to alter the licensure or certification by endorsement to practice as a general real estate appraiser.

     

  7. 12 AAC 70.125, Application for approval as a trainee appraiser, is proposed to be changed to alter the licensure or certification approving a person as a trainee appraiser.

     

  8. 12 AAC 70.126, Application for approval as a supervisory appraiser, is a proposed new section that establishes licensure or certification requirements for approving a person as a supervisory appraiser.

     

  9. 12 AAC 70.140, Standards for acceptable education, is proposed to be changed to alter the standards for classroom hours of education for initial certification.

     

  10. 12 AAC 70.210, Approved continuing education courses and seminars, is proposed to be changed to alter the requirements for approved continuing education courses and seminars.

     

  11. 12 AAC 70.215, Approved online courses, is proposed to be changed to alter the online courses approved by the board.
  12.  12 AAC 70.220, Hours of continuing education required, is proposed to be changed to alter the continuing education requirements for renewal.

     

  13. 12 AAC 70.935, Supervision of trainee appraisers, is a proposed new section that establishes requirements for trainee appraisers and supervisory appraisers.

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Jun Maiquis, Regulations Specialist, Division of Corporations, Business and Professional Licensing, P.O. Box 110806 Juneau, AK  99811-0806.  Additionally, the Board will accept comments by facsimile at (907) 465-2974 and by electronic mail at jun.maiquis@alaska.gov.  The comments must be received no later than 4:30 p.m. on April 1, 2015.

Box 110806 Juneau, AK  99811-0806 or by e-mail at jun.maiquis@alaska.gov.  The questions must be received at least 10 days before the end of the public comment period.  The Board will aggregate its response to substantially similar questions and make the questions and response available on the Board’s website at http://commerce.state.ak.us/dnn/cbpl/ProfessionalLicensing/RealEstateAppraisers.aspx or on the Alaska Online Public Notice System.  The Board may, but is not required to, answer written questions received after the 10-day cut-off date and before the end of the comment period.

After the public comment period ends, the Board of Certified Real Estate Appraisers will either adopt these or other provisions dealing with the same subject, without further notice, or decide to take no action on them.  The language of the final regulations may be different from that of the proposed regulations.  You should comment during the time allowed if your interests could be affected.  Written comments and questions received are public records and are subject to public inspection.
