Notice of Proposal to Adopt Regulation Changes in Regulations dealing with Drinking Water

BRIEF DESCRIPTION

The Department of Environmental Conservation proposes to amend the drinking water regulations at 18AAC 80 to incorporate the requirements of the new federal law, “Reduction of Lead in Drinking Water Act” (Safe Drinking Water Act, Section 1417), including changing the definition of “lead-free.” Proposed revisions also include updates to drinking water publications adopted by reference.

The Department of Environmental Conservation proposes to adopt regulation changes in Title18, Chapter 80, of the Alaska Administrative Code, dealing with drinking water, including the following:

Repeal and readopt 18 AAC 80.010(b), which contains publications adopted by reference, to group similar publications together, add four new publications, and update ten publications to reflect the most current version now available.

Amend 18 AAC 80.030(b)(1), to incorporate the new federal requirements regarding “lead-free” components for drinking water systems.

Repeal and readopt 18 AAC 80.500, to incorporate the new federal requirements regarding “lead-free” components for drinking water systems.

Repeal and readopt 18 AAC 80.1990(a)(76), to revise the definition of “lead free” to reflect the new federal requirements.

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Gloria Collins, Regulations Specialist, Drinking Water Program, Department of Environmental Conservation, at 555 Cordova Street, Anchorage, AK  99501.  Additionally, the Department of Environmental Conservation/Drinking Water Program will accept comments by facsimile at 907-269-7650 and by electronic mail at decehdw.publiccommentsregs@alaska.gov.  Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system and using the "comment" link.  The comments must be received no later than 5:00 p.m. on April 24, 2014.

After the public comment period ends, the Department of Environmental Conservation will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action.  The language of the final regulations may be different from that of the proposed regulations.  You should comment during the time allowed if your interests could be affected.  Written comments received are public records and are subject to public inspection.
